Terms of Service

EasyQ is an AI-powered office automation platform developed and operated by Gigabyte Consultancy B.V. (KvK 85493368, BTW NL863641945B01), a software company registered in the Netherlands. The service is available at www.easy-q.nl and is designed exclusively for Dutch installation and construction companies. The service includes:

• Mini-website, on-site chatbox, self-service booking and scheduling (all tiers)
• AI-generated quote drafts with human approval, invoicing and payment links (all tiers)
• Email channel (all tiers)
• WhatsApp and SMS intake, and the configurable intake questionnaire, Tier 2+
• Project workspace, expenses, trips, accounting sync and reminder ladders, Tier 2+
• AI Command Center with voice, bank feed, telephony, Instagram, Messenger and Service Desk, Tier 3

Access to features depends on your active subscription tier. EasyQ reserves the right to update, modify, or discontinue features with reasonable notice.

Key transparency disclosures:

• AI identification: When your customers interact with EasyQ, they receive an automated message disclosing that they are speaking with an AI assistant (compliant with EU AI Act Art. 52).
• Human oversight: No legally binding quote, invoice, or calendar booking is sent without explicit contractor approval. All AI outputs are reviewed by a human before reaching end customers.
• AI provider: EasyQ uses OpenAI (GPT-4o for language tasks, Whisper for Dutch voice transcription). OpenAI does not use API data to train models.
• No automated decisions affecting rights: EasyQ does not make automated decisions that produce legal effects on your customers without human review.

You remain responsible for the accuracy of quotes, invoices, and communications sent to your customers after approval.

EasyQ acts as a data processor for personal data belonging to your customers. You remain the data controller for that data.

By using EasyQ, you agree to our Data Processing Agreement (DPA), which is incorporated into these Terms. The DPA specifies:

• Categories of data processed on your behalf
• Sub-processors authorised to handle that data
• Technical and organisational security measures
• Your rights to audit and receive deletion confirmation

You warrant that you have a lawful basis to share your customers' data with EasyQ (e.g., a legitimate interest or contractual necessity). For a copy of the DPA, email support@gigabyteconsultancy.com.

EasyQ uses the following cookies on our platform and website:

We do not use tracking cookies for advertising. We do not sell cookie data to third parties. You can withdraw consent for optional cookies at any time via your account settings.

You may not use EasyQ to:

• Send unsolicited marketing messages (spam) to individuals who have not consented
• Process sensitive personal data (health, financial, biometric) beyond what is required for job intake
• Impersonate another business or individual
• Circumvent rate limits or security controls
• Violate any applicable Dutch or EU law

Violation of these terms may result in immediate account suspension.

To the maximum extent permitted by Dutch law:

• EasyQ is provided "as is" without warranties of fitness for a particular purpose.
• EasyQ is not liable for lost revenue, missed opportunities, or business decisions made on the basis of AI-generated drafts.
• Our total aggregate liability is limited to the fees you paid in the 12 months preceding the claim.
• Nothing in these Terms limits liability for gross negligence, wilful misconduct, or death/personal injury.

You are responsible for reviewing all AI-generated quotes, invoices, and messages before sending them to customers.

These Terms are governed by the laws of the Netherlands. Any dispute arising from these Terms shall be submitted to the exclusive jurisdiction of the competent court in Amsterdam, unless mandatory consumer law provides otherwise.

If you are a consumer (not a business), you retain the right to bring proceedings in the courts of your country of residence where EU consumer protection law applies.

We may update these Terms from time to time. For material changes, we will notify you by email at least 14 days before the changes take effect. Continued use of EasyQ after the effective date constitutes acceptance.
